End User License Agreement (EULA)
IMPORTANT Read this carefully before using this product. This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or an organization) and Braille2000, LLC, ("Braille2000") for the software program that accompanies this EULA ("Software"), its documentation, and its right-to-use license. You agree to be bound by all terms of this EULA by installing or using the Software. If you do not agree, do not install or use the Software. You may return your right-to-use license to Braille2000 for a full refund within ninety (90) days of purchase.
Ownership of the Software
1. The Software is owned by Braille2000, LLC, a Nebraska Limited Liability Company, and is protected by United States copyright laws. Braille2000 retains ownership and all rights not expressly granted to you by this EULA.
Grant of License
2. Braille2000 grants to you the right to install and use the Software according to the class of license, as follows:
Without right-to-use license
You may install and use the software to evaluate its features, knowing that no useful final result or document will be produced.
With a right-to use Subscription license
You may install and use the software for a given period of time by paying recurring monthly license fees. Any results or documents generated are your permanent property.
With a purchased right-to-use license
An enduring right-to-use license can be purchased for a fee. The license continues in force so long as you abide by the terms of this EULA.
You may install and use the Software on as many computers as you wish, provided that you abide by the restrictions set forth herein. The Software is designed to run on the Microsoft Windows x86 platform, Windows 7 and newer, 32-bit and 64-bit systems. You may install and use the software on other platforms, such as a VM running Windows on a MAC, or WINE on Linux, etc., at your own risk and without warranty or specific tech support. Without a right-to-use license, the Software is for evaluation only, without full function, and without warranty.
Restrictions on Use and Transfer
3. You must acquire a right-to-use license from Braille2000 in order to use the Software with full function. The capabilities of that full function are determined by the nature of the right-to-use license that you acquire.
4. Each right-to-use license is to be used to support the work of one user on one computer. A license can be used at multiple computers or workstations, but only serially, one computer or workstation at a time. You may share your license with co-workers so long as only one user at a time is using the Software on only one computer or workstation at a time.
5. You may not transfer or assign the right-to-use license to another party except with the prior express written permission of Braille2000. You must notify Braille2000 in writing of the transfer and identify the transferee, who must also accept this EULA.
6. You may not reverse engineer, decompile, or disassemble the Software. When the right-to-use license is packaged in a hardware “license device” (a dongle), you may not reverse engineer or try to duplicate the device. You may not modify the Software or create any derivative work of the Software.
Limited Warranty
7. Braille2000 warrants that the Software will perform substantially in accordance with its accompanying documentation for a period of 90 days from the date of your receipt of the right-to-use license. Any implied warranties on the Software are limited to 90 days. Some jurisdictions do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you. Your sole remedy if the Software fails to perform as desired is to return the right-to-use license within 90 days of purchase to Braille2000 for a full refund of the purchase price.
8. Braille2000 warrants that a hardware license device we supply for the Software will operate with the Software. If a hardware license device fails, Braille2000 will replace it by exchange only without fee. If no exchange is possible (if the device is lost or stolen, etc.) a fee will be charged. The replacement device might not be identical to the original device.
9. Braille2000 warrants that it will use good faith commercial resources to maintain the Internet service that supports the Internet-based right-to-use license, but no warranty is given that the service will be without interruption from time to time.
10. Braille2000 disclaims all other warranties, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to the software and the accompanying written materials. This limited warranty gives you specific legal rights. You may have others, which vary from jurisdiction to jurisdiction.
11. Braille2000's entire liability and your exclusive remedy shall be the return of the price paid.
12. Conversion between print and braille is not an exact science in most circumstances, and all software is likely to contain faults despite careful preparation. You therefore understand that the output of a fully automatic conversion cannot be assumed to be correct, and that it is your responsibility to undertake whatever measures, such as proofreading by a qualified person, that may be appropriate to assure the quality of output that is necessary in a given situation. In no event will Braille2000 be liable to you for damages, including any loss of profits, lost savings, or other direct or indirect, incidental, punitive, special, or consequential damages arising out of your use or inability to use the software. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
Support and Maintenance
13. Reasonable technical help and support on installing and using the Software will be provided to holders of a right-to-use license upon request and without fee.
14. From time to time, new releases of the Software may be offered at the Braille2000 Internet site and/or via the Software itself. Use of new releases is not mandatory and most new releases are currently expected to be without additional fee. From time to time, new capabilities may be offered for additional fees.
Other Terms
15. This Agreement is governed by the laws of the State of Nebraska, USA, without regard to its conflicts of laws principles. Venue for any disputes arising out of this agreement shall be in Lincoln, Nebraska in the courts of said State of Nebraska.
16. This EULA is the entire agreement between you and Braille2000 relating to the Software. If any provision of this EULA is held to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect. This agreement may be modified by Braille2000 by posting an updated version of this agreement on the Braille2000 website; this agreement may not be modified by you without the written approval of Braille2000.
